In Texas, as in all states, there are two types of custody—physical custody and legal custody. Physical custody refers to where your children physically spend their time. Legal custody refers to those issues that affect the health and welfare of your child, such as medical care, educational opportunities, religious training and participation in extracurricular activities.
The guiding principle in all Texas custody and visitation matters is what the law calls “the best interests of the child.” Factors that the court commonly considers when making that decision are:
